West Virginia – Probate Creating Issues For A Sale After Buying A Home From An Estate

Hi all, so I am currently running into an issue that we had no previous knowledge of. I purchased a home from an estate back in September of 2021. Escrow from the estate was dealt with through an escrow company and lawyer of the deceased’s estate. It closed without issue from a cash purchase and I received the deed and other relevant documents from the sale. I proceeded to have work done on the house and remodeled it to resell.

That brings us to today. The home is currently under contract to sell, everything was going well with a closing date of Jan. 18th. I received a message from my relator today stating the estate never closed due to a missing “IRS payment for disbursement” from previous owner/seller. The current buyer’s loan issuer sent my realtor that info and is saying they cannot loan on the house unless the probate is closed on the estate. That is really the only info I have been given.

Anyone with experience dealing with this or similar situation in the past? Did this create a problem with you selling the house? I can provide more info on the transactions if needed, but really there weren’t any issues for me to buy the house, but some are coming up as I try to resell the house. I have all documents saying I own the house now so puzzled by why the open probate affects me and what I assume is now my property. Thanks for any and all information!
