We’re getting screwed by our builder

I’m searching for a home we found a great property with a beautiful lot within our budget. We quickly moved on the house after reviewing some of the other work done by this builder with great excitement. On the MLS the price was listed as $534k and some change, BUT when it came down to signing the contract the price was suddenly $550k… although this gave us pause, after some research prices of homes in this area were going up generally (decent location, large lots, high demand and growing area) across multiple builders sites in the same subdivision, so we pressed onward excited to begin the process. We were told that since the home was in dry out condition (framed with the exterior walls) we could pick the exterior materials, interior details, and all of the other fun design details. This was just over a month ago. Over the past few weeks we have not heard much from the builder unless we initiated contact, which seemed to be an issue with them ( like they were annoyed). And to be clear, we’re asking very few general questions as there are things installed in the home that are not shown on the plans we received and asking for plans that aligned with whatever the subcontractors are following. Five days ago was the big error though… I visited the property site, as I have been every three days or so, to check progress since we had posed questions to the builder that were still unanswered and then discovered that the exterior has been mapped for stone and brick where we fully intended on going with a completely different appearance. At this point we had only been contacted by the lighting vendor and had not received any communication as far as the other vendors to contact for exterior or anything else – they continuously told us they would send information and didn’t. So I reached out to the builder again and sent photos of what I discovered for the exterior… no response. Today, five days later, (again) I got in contact with the owner of the company through my realtor and he told me “we aren’t allowing for customer selection on exterior”. I then expressed my concerns and that I had not received any information as to what we can or can’t pick and that we were told multiple times that we could choose the exterior… He said that we could make some minor changes depending on what we are looking for, which I was ‘ok’ with. He then puts me in contact with the selections person who claims “there is no stone on this house it’s all brick I ordered it myself” then tells us that to paint it would be $11,000… my husband tells them (we discovered the company president was listening in) that this is a fucking joke and that we are getting screwed and then they threaten to cancel the contract and hang up on us. I call back to try to resolve the situation and get threatened with a materials escalation clause … so I’m sure they will figure out a way to tack on some outrageous extra costs we will get stuck with or we will have to back out of the whole deal.

Basically I’m just venting as this has been a completely outrageous experience, we are getting screwed and will probably lose an enormous amount of money since they can’t seem to keep anything straight… I feel like they lied … and are trying to cover their ass. I hope this is not common but I do wonder how many other people this has happened to… I’m just dumbfounded. And the exterior is just the biggest mistake, we have had this same kind of story from them, during the few times we did pose questions, on appliances, concrete, cooktop, all kinds of things… they say one thing then do another.

I. Don’t. Know. What. To. Do. And am completely aware that with the market how it is they will just sell to the next buyer. So there’s not a whole lot that can be done as far as I know.

But also want to include that in the contract, there is a design mock up of the home that shows brick and stone which we have requested changes on since day 1 and didn’t receive anything. And their deign team claims that “the house has always been brick” but I believe this came from me talking with the owner and telling him “if we can just have all brick and no stone then that will work for us” (versus trying to get something totally different at this stage). It is consistent backpedaling on their part.

We were sold on the idea of being able to do a semi-custom build that was presented to us, but that is clearly not the case. I feel completely mislead.
