We are under contract on a property with a permanently affixed manufactured home in Michigan with closing within the week. The title company cleared the land — but stated that the title on the manufactured home wasn’t retired and isn’t part of the land. Upon further investigation, turns out the seller has lost the title to the home and refuses to get a duplicate copy of the title from the State to complete the affidavit of fixture. We really like the property, it is lakefront in a great neighborhood and it has taken a long time to find it.
What are the risks of going ahead with the closing without the title and getting it later? Any better way to force the sellers to get the title?
