I’m obviously not looking for legal advice, I just want to know if anyone has been in a similar situation before.
We are selling our house in NC- we’d had renters in it for the past year and half, but they bought a house and broke their lease, the past year(despite no issues with our great renters) soured us on continuing to rent and our personal circumstances have changed and we no longer see ourselves moving back there, ever. So we put it up and it sold quickly, great.
The issue is that we had a hurricane hit it last September, put a tree through the roof. It was all covered by insurance, but we had the inspection done and there is an issue with the repairs done to the roof. They left damaged beams up there, there are 2x4s floating off into nothingness, it’s a mess, but it’s one truss, so the repair shouldn’t be too intense. It’s been less than a year and the work is still under warranty, but the contractor is effectively ghosting me. I call/email constantly and he’s gotten back to me twice-basically just to say ‘yeah got your email about the issues’ and ‘I forwarded this to my roof guy but haven’t heard back. I’ll let you know when I do’.
We are supposed to close soon and this ass is dragging his feet. I know we are technically able to close and have the repairs done after, but I’d really, really like to avoid that and all that headache. I don’t plan to pay these guys anything, they’re fixing work they did that’s garbage AND still under warranty.
Does anyone have any suggestions? I’ve thought about hiring another company to repair it and suing the original contractor for the cost + attorney fees, my realtor says he thinks I have grounds, but I’m not sure. I plan to talk to the lawyer he recommends anyhow, but has anyone ever been in a similar position? I’m just trying to walk the line between Karen and naive!
