I had a lady today show up to view my “1 bedroom + bonus room” apartment today, and she wanted to rent it and I have QUESTIONS.
The bonus room is a garage converted to bedroom without permit, which is very common in my VHCOL area. This bonus room was converted VERY nicely, and it shows really well. I also made sure it follows all fire safety/egress code for a bedroom in our city.
She loved the place, and she wanted to rent it! This is not surprising; I rent the unit for basically the price of a 1-bedroom with the same features.
All well and good… But she brought her 4 children to the viewing, all under 10.
I’m confused about the laws for this. If it were a legal 2 bedroom apartment and she passes all other requirements I’d be legally required to rent her the apartment as you’re not allowed to discriminate based on children and it doesn’t violate max occupancy. (CA Fair Housing Act.) If it were a simple 1 bedroom apartment then I’d not be legally allowed to rent it to her as it violates max occupancy and would be considered “overcrowding”.
Does anyone know where “bonus rooms” lie in the law here? Theres very little that I can find online.
Would renting to her open myself up to lawsuits from her, her health insurance or the fire marshal if anything were to happen, despite my caution about fire safety and egress?
So long as it’s not going to cause me potential problems, I’m not opposed to renting to her or anyone with children, even lots of them. If nothing else, the fact that so many people would be opposed to having child occupants likely just means I’ll have a very long term tenant. I just want to make sure I’m keeping myself legally protected.
Are there other things I may not have thought about at play here?
