I signed an purchase agreement for a new construction home in March. In the agreement, there was a required 5kW solar system (16 panels/5.6kW) required by code, and we were required to purchase it from Sunpower at the cost of $22K. Wasn’t too happy about it, but fine.
This morning, I got a call from Sunpower telling me they sold the wrong system and they discovered that they now need a 17 panel (5.95kW) system and want to charge me for it. The charge for the new system is $25K, which is ridiculous for a SINGLE new panel. MY guess is that the price of solar panels have gone up so they basically repriced the entire system.
I’m scouring our purchase agreement now to figure out what our rights are here.
My guess is that some house they recently built failed inspection because the system didn’t meet title 24 requirements and they just found out. The sunpower guy said he was calling every person with our floor plan.
Anyone have experience with this sort of situation?
