My mom initially sold her house in May for it’s asking price. When they were doing a survey they discovered that 10 feet of her patio was actually her neighbors. That buyer pulled out and my mom went about putting up a fence. She then sold it again before the fence was erected but disclosed that the patio would be losing 10ft and a fence would be built across it. Someone put in another asking price bid and said they had no problem with the fence and the patio but pulled out last minute again.
So now my mom had the fence built after she got another survey done and so the fence is 100% in the right place. The house was sold again to a buyer that was all cash and was the asking price again but she had lowered the asking price. The sale had no contingencies and a 15 day escrow. It closes tomorrow.
Even though it was a cash offer the buyer is going about getting a loan anyway, which I know is common (that is, buying a house for cash and then financing it after you already own the property). The buyers bank had the yard inspected so that they could record that the survey was correct. And they said it was fine and yet she is still super worried that something will go wrong. Despite the offer being a cash offer and having no contingencies, therefore it doesn’t matter if the buyer gets a loan or not.
Then, last Wednesday, she found a property line marker near the other back corner of the yard (opposite the newly built fence on the patio). It was sledge hammered into the ground and covered with stones but somehow she was able to see it. It’s not exactly on the corner but the marker is supposed to denote where the corner should be. It’s about 1′ off She was worried that if the buyer saw that after she moved in that the buyer could pull out of the sale and sue her. So she told me to dig the marker up which was hard because it was about a two foot 1.5″ diameter pipe. I pulled it and we went home. When we got home she was again freaking out because I guess it’s illegal in CA to pull them out. So we went back and I hammered it in to the exact same spot. I read that those markers, the metal rods, are supposed to be hurried and normally can only be found by digging or using a metal detector. So I covered it with dirt and pebbles. The next day she had me go back and uncover the marker so that it was visible.
Ever since that happened last Wednesday she has been stressing everyday because, “what if the neighbors saw you remove it and they tell the police? What if the new buyer sees it and sues me because I removed it? What if the buyer pulls out because it’s 1′ west and 1′ south of where the corner of the fence is? What if the marker shouldn’t have been buried and there are too many rocks and dirt covering it?” I keep telling her that it doesn’t matter because no one saw and we put it back exactly where we found it. EXACTLY
Escrow closes tomorrow but does she really have a reason to be worrying so much? Her RE agent says there is nothing to worry about. I’m fact that’s what everyone says and yet she still is freaking and will be freaking out long after the new buyer moves in.
I totally understand that why she worries because twice before has her sale fallen through because of the property line issue. But to be worried even after the buyer moves in is ridiculous, right?
