listing unpermitted space as part of square footage – is this legal?

just found out a house i made an offer on is listing an unpermitted bathroom and den in the basement as part of square footage- is this legal? The sellers did not disclose this until asked. They clearly knew it was unpermitted and their agent probably knew too…

they are refusing to get permits after the fact, and refusing to decrease the price.

would you walk away…? not sure if unpermitted space is a big deal.
