I’m renting a room in Southern California. Without consulting myself or my other roommate, my landlord has moved in 9 extra family members (who aren’t paying rent) three months after I have signed the lease. I’m only on a 6 months lease so I have three more months, but I don’t want to stay because I can’t even use most of the house, it doesn’t look like they’re leaving anytime soon. Basically I’ve discovered he’s broken the lease in three ways:
1) reasonable use of “quiet enjoyment” 2) unsanitary conditions due to dog pee and poop that is never picked up outside or inside the house. He allows his youngest dog to poop inside the house on the floor in the same room as the kitchen. They have also pooped and peed on my bathroom floor several times, and a few times in my room, and on my bed. I have taken pictures so I have proof. 3) breaking occupancy laws – there a total of 12 people in the house now, and it’s only a four bedroom house so there’s only supposed to a maximum of 9.
So I know I’m legally justified in breaking the lease. I want to know how much money am I legally justified to ask him for (relocation costs, moving fees, and anything else I’m legally entitled to). I am for sure asking for my entire security deposit back. I’m pretty stressed out because I don’t have a lot of renters history, and I’m just worried it’ll take me a while to find a new place. I feel like I shouldn’t have to pay for a hotel my own dime, given that this is his fault. I don’t have many possessions so I’m not going to even hire a moving company, but if I am legally entitled to ask for money for that still I would like to. It’s been really stressful for me to live there in those conditions. These people have been there for almost 2 months now, and part of me wants to even ask for a part of my rent back for those two months, since I was unable to use the rest of the house as promised in my lease. The new people use the washer and dryer daily, all day, so I have barely any time to do my laundry. They also use the kitchen and sit at the table all day with the exception of breakfast time. They also have taken over an entire fridge leaving only a small corner for my food. I don’t think the kitchen use was clearly stated in the lease, but the use of the washer and dryer is. I pay $900 in rent, I don’t pay for any utilities. I have paid my rent in full and on time each month. How much much compensation would you guys ask for if you were in my situation?
