Trying to sell my house in Colorado before the end of the year to time with a move out of state. Wanted to wait until mid-October to list, but Realtor brought me offmarket offer with December close and rent back until I move. Turns out, Realtor is representing buyer too, which I believe means it’s a dual agency deal, which I believe is illegal in Colorado.
The offer isn’t terrible, although I think I’m going to counter to cover everything the buyer wants to cover their loan/closing costs, but my Realtor is pushing hard to make this deal work, and I think it’s because they’ll get a 6% commission, vs what they’d get if we list in a month. Also, I’ve got a zillow offer for $45k over what this buyer was offered if you account for all the rolled up costs.
Should I continue working the deal and not worry about it, or should I prepare to drop the deal, confront my Realtor about the dual agency and maybe just take the zillow deal?
