Location – San Francisco Bay Area
I was the buyer of a property and looking to a sue my agent for breach of duty / negligence. During the sales transaction he did act on the best interest of the buyer, but instead acted on the best interest of the seller by maximizing the profits on the sale. The house had no offers and was sitting in the market for over 2 weeks, when I decided to make an offer, magically he proclaimed 3 other offers one of which was higher than mine, he told me to increase my bid twice, yet still lower than the supposed highest offer, but took my lower offer still. During the sales process, I had asked him to obtain documentation on past repairs and issues of the house. He said all of that was in the disclosures.
After moving in the house, I have come to realize there were many items that were undisclosed. 1) House is being supported with push piers because it was/is sinking due to water intrusion 2) Because of water intrusion, there was a sump pump and drainage system built 3) Foundation is damaged and showed signs of water floods/stains, the rebar is exposed and corroded, foundation cracks everywhere, foundation is also hanging in mid air due to push piers lifting 4) cracks in every single room of the house due to push pier lifting the home 5) Sewage discharge coming from the neighbors since 2019 + 6) Main water valve leak 7) roof will leak during rainy season, roofer confirmed its 20+ years old
The inspectors were hired by him and they did not disclose nor note any of the above.
