First time home buyers. We went to see a lot in a Yet-to-be-built community 1st week of Jan 2021.Supposed to be a late Spring delivery. Signed P&S in Feb with the closing date as Aug 15. Started seeing the construction process begin in April/May. Was told ours is the first house to be done. Late June they get back to us asking for Sep 12. Signed extension. then came another extension for Sep 27. Then comes another for Oct 15. This time,we let our attorney to talk to them on what’s causing the delays and they say covid and town stuff, if we are not interested, they can void the contract and give our 5% deposit entirely back to us. At this point we were too deep into this to back out so we signed that one too. Appraisal happened yesterday. Today, 48 hrs before the closing, the sellers agent (SA) replies to buyers agent(BA) questions about closing saying that they are delaying again (no reasons given) and that the BA can’t argue with the SA, since its the builders’ decision. No particular date also given for the closing!! LIKE WTF! I called the town and they haven’t even scheduled any inspection on that house and the last inspection date on this house was July 17.The town also said that there are absolutely no delays on their end and they wouldn’t let the closing to be upheld due to them anytime.
I locked our rates in Sept and the lender now says if this rate expires the rate is gonna be higher. Our lease was ending on July 10, so we spoke to our rental agency to put us on for a month to month that’s setting us back by 3300$/month ever since July and we gave our final notice to evacuate for Oct 30. They aren’t allowing us to go into the house since last month saying no until the final walkthrough. Meanwhile,There are other lots to be built and they are putting them on the market for 100-150K over what they were asking in Jan. I am absolutely beyond frustrated. I spoke to my attorney and she says she can’t do much about it. I would appreciate if anyone can advise on how to deal with this situation. PLEASE! Thanks!
