Help, any advice?

Hi all, I need advice. My real estate agent put my property in escrow less than 24 hours after the “ink” was dry on the docusign.

I have a contract that says #5 – “Within 3 business days from mutual execution of this counter offer, buyer shall provide seller with buyers financials representing buyers capacity to close the transaction. Escrow shall not open until this condition has been satisfied and this condition will be based solely on seller’s discretion. Should this condition not be met, the contract shall be null and void.”

Buyer never provided financials. Buyer refuses to sign cancelation of escrow. Not sure what to do at this point.

Can I still sell my property in California even if an escrow is opened?
