I bought a new townhouse build that’s scheduled to be complete in December. I paid my earnest, and earnest for the upgrades I added. The builder is starting to break ground, and informed me that they had to change the plans due to osha standards. Now my backyard space (which is a back patio and a few feet of grass) is being eliminated entirely. Now my driveway is going to be right up to a screen door. My question is what are my options legally? This is not the design I signed off on, and there counter to this change is to fence in the front of the townhouse (which is a small useless space along the main road). I just want to get my money back and get out of this, I think this change will seriously hurt the value of the house and it’s just not what I signed off on. Am I entitled to get out of the contract due to a changed design? I looked at my contract and it’s pretty general on this and doesn’t really specify.
