MA-We just had an offer accepted on a house. Everything about the house so far is great but looking at parcel data against imagery (imagery is accurate, parcel data might be outdated), the driveway clearly crosses into the neighbors property (according to current parcel data). Seller’s realtor says that there is no disclosure about that and the fence that runs along the two properties is actually a foot into our property. Again, parcel and imagery strongly disagree with this and there is nothing in the registry of deeds about either properties regarding land swaps or anything.
At what point in the purchasing process can this be determined? During assessment for the mortgage? After purchase with private survey? Should I inquire with the town assessor on my own? My instinct is to check with the assessor and see if their is updated parcel data available. Anyone ever run into something like this? If the driveway is what it looks like and crosses into the neighbors property, can that lead to long term technical issues about legal access to my house?
