So I am selling to a person with a VA loan. They offered over asking with appraisal contingency and seller assist. I accepted, the appraisal came back 20k low and despite that it seems poorly done (most comps totally different style of home, locations while not far more city vs quiet street mine is on, missing many aspects of the home such as waterfront location/views etc) I chose to dispute the appraisal for the obvious errors. Then after a day of considering and pressure from family chose to accept the appraised price to just be done with it and I moved out 2 months ago and will be moving to my new home soon. Now that I said I’d accept the appraisal price with no seller assist (which was what their agent asked my agent about) the seller is suddenly wanting to terminate. I feel there is likely another reason they’re looking to terminate and they’re trying to use the appraisal as an excuse. Because I am agreeable to the appraisal price which is a much better deal to the buyer and they are the ones choosing to terminate am I entitled to at least good faith deposit as they’ve now wasted a month of my time and I have to pay the mortgage and upkeep of the home for another month or so likely because of it? Their agent is stating that with a normal loan we would be entitled to the good faith but because it’s a VA loan we do not get to keep it. Anyone have any knowledge on this? Agents have been arguing for a few days and id like to know what to expect as an outcome.
