Eviction help

I was wondering if anyone could give some advice my situation.

I am in California.

Last month I notified my landlord I was going to be three weeks late on rent because of surgery and not working. He said agreed and seemed to have no problem with it. Exactly three weeks later on the agreed date I attempted to pay the late rent and he attempted to charge me a $390 late fee. Then stated than any money I give to him goes to his fee first and the remainder to the rent owed.

I refused and attempted to ease the situation by asking to use my last months rent (paid when I first moved in, ALONG WITH AN EQUAL AMOUNT DEPOSIT) and move out in 30days.

He said if I choose to ask that he will evict me and since he is evicting me before I request a move out date I am not aloud to use my last’s month rent.

That was last month, I have stayed in my apartment without paying him, with the mindset that I have already paid and am moving out on the 4th, in 2weeks.

He walked into my apartment without knocking and I kicked up out, nicely, refusing to further the conversation.

The next day he shut off my power while I was at work!!!

He has now served me with a 3day notice to pay or quit which includes OVER $1200 in late fees and neglects to mention my last months rent payment.

So my question is how to proceed, although uneducated on the topic I have researched enough to know that the 3 day notice is FULL of mistakes and misinformation that are readily provable.

Any advice on the next step would be much appreciated.

The lease started out as 10 months and I have been here a year, when lease ended it became month to month.
