Deposit and TDS (CA)

So I’m in the process of purchasing my first home, while I am also acting as the agent and working with my broker to purchase the property. This also happens to be my first sales/purchasing experience as an agent. I had a question, we have submitted the offer, received a counteroffer, and are ready to accept it. But with the counter offer, they are asking for a much larger deposit than what seems necessarily reasonable. We’ve seen the home and all seems to be ok, but I’m wondering about accepting the offer before having seen the Transfer disclosure statement. If we accepted the counter and placed the deposit, but the TDS came back with something alarming, would the deposit be returned to us? Should we have received it before the offer was made?
