I’m in the beginning stages of selling my house in Colorado. I’m in a sought after neighborhood, on average the houses have sold for $1MM for the last few years, our house should be the same. One of my hang-ups has been the 2.8% commission for both agents, or $56k in commissions. Recently an agent brought a buyer willing to pay a premium and offered to handle the contract on both sides for 2.8%, this would save us $28k. From what I’ve read dual agency is illegal in CO, but she claims this is common and has closed on many houses in this fashion. She would still be representing the buyer, but bring us on as a customer.
Is this legit? I would like to run this all by a RE lawyer before we enter any contracts but wanted to see if this passes the smell test first. I don’t want to get to the closing table and title tells us we have an invalid agreement or something.
