My fiance and I are under contract for a house in Ohio. Semi-short story: he’s still married to his ex. They’ve lived separately for almost ten years now. Separate financials this whole time. We were under the impression that since their finances have clear proof that he’s purchasing this house without “marital funds”, she will have no claim to our house. Just to be safe, we are planning to have the title in my name only…the mortgage will be in both our names. We plan to add his name later once they get a divorce and we get married. She knows we are looking for a house. We haven’t mentioned to her or the kids that we are under contract. She previously stated she will sign papers giving up any possible claims she might have to our house.
The seller’s agent wasn’t sure if his ex will need to be there when we sign for the house. She plans to look it up but its now weighing on our minds that this could be a hiccup in getting our house. His ex will agree to things and then change her mind at the last second. Has anyone else dealt with this and know if we need to bring her along (which she wouldn’t agree to) for signing? Do we need to get her to sign papers giving up claim to the house?
