Buyer Awaiting Tenant Eviction

I have a contract where property is supposed to be delivered tenant vacant by end of escrow

Issue here is that escrow was meant to close 1/04/22, however tenant has refused to vacate the property and it is now up to the Seller to evict them and ensure the property is move in ready

To tack on to this issue, I had to redo my rate lock or it would have cost me thousands of dollars and possibly tens of thousands to maintain my rate due to the unknown timeline for the tenant to vacate and be able to close the property

The buyer has not agreed to cover costs related to extending the rate lock past our initial escrow closing date, so I’m on the fence around whether I should wait for the property to become vacant and hope it’s soon, try to litigate against Seller to force them to pay for any extensions, or just abandon the purchase and continue my search

What are our thoughts? It is a 2bd 3ba townhome in Southern Ca appraised at $475k
