So I backed out last minute from a rental contract where I paid a sec. deposit. The contract said upon signing, sec. first and last would be due. I explained I would need 4-5 days to get the money. They still had me sign.
I gave notice the next morning that I would not be renting, and got another spot. There are 3 other candidates that were turned down. I do not know if any good faith effort was made to sign with them. I would think deposit would have to be returned (being held as partial payment for first+last that was not paid).
My question is, since I was never given keys and did not take possession, am I still liable to pay first and last? Landlord thinks so.
Also lease break clause would be 30 days notice (which I gave by email), and chance to find sublettor to be approved by landlord. If not, one month rent as penalty.
I am in Mexico, she has a signed document with my name, but no ID. She is in Switzerland, does not have residency status (but owns 2 properties). Uncle in real estate says go ghost…
I also made a good faith effort to rent space before she left. I still have an ad up that people are responding to.
Any advice would be most appreciated.
